Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of, and is incorporated by reference into, the Terms & Conditions for MedicareGuideline (“MedicareGuideline,” “we,” “our,” or “us”). It applies to every visitor, user, account holder, client, partner, and affiliate (“you” or “your”) who accesses or uses MedicareGuideline (the “Site”) or any services, data, calls, leads, or other products we provide (collectively, the “Services”).

By using the Site or Services, you agree to comply with this AUP. If you do not agree, do not use the Site or Services.

1. Scope & Purpose

This AUP is designed to:

  1. Protect the legal rights, security, and reputation of MedicareGuidelineand all users;
  2. Promote compliance with applicable laws and regulations; and
  3. Ensure the integrity, reliability, and quality of the Services across all MedicareGuideline brands.

2. General Rules of Conduct

You must not (and must not allow, encourage, or enable any third party to):

Illegal Activity Use the Services for any activity that is illegal, harmful, or fraudulent, including money laundering, terrorism, or the sale of illicit goods.
Unlawful Marketing Violate the Telephone Consumer Protection Act (TCPA), CAN‑SPAM Act, state “mini‑TCPA” statutes, or Do‑Not‑Call (DNC) rules; send unsolicited or unconsented marketing communications; spoof caller ID.
Privacy Violations Collect, share, or resell personal information without legally sufficient consent; disregard opt‑out signals (e.g., Global Privacy Control); ignore data‑subject rights.
Harassment & Abuse Transmit content that is harassing, defamatory, threatening, hateful, or discriminatory.
Intellectual‑Property Infringement Upload or distribute content that infringes copyright, trademark, or other IP rights; violate the DMCA.
Security Violations Introduce malware, viruses, or harmful code; attempt unauthorized access; scan, probe, or test for vulnerabilities; perform denial‑of‑service attacks.
Automated Scraping Scrape, crawl, spider, or harvest data from the Site or Services without express written permission.
Misrepresentation Impersonate any person or entity; misstate or forge headers, email senders, or caller ID information.
Resale Without Compliance Resell data, leads, or calls to third parties who do not meet the same legal and contractual standards outlined in our Terms & Conditions and this AUP.
Excessive Load Take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

3. Content Standards

Any content you transmit or request us to transmit must not:

  • Violate any applicable law or regulation;
  • Contain obscene, pornographic, or sexually explicit material;
  • Promote violence, self‑harm, or illegal activity;
  • Contain false or misleading statements or claims;
  • Include personal data of minors without verifiable parental consent.

4. Security & Integrity

You must:

  1. Implement reasonable administrative, technical, and physical safeguards to protect any data you receive from us, including multi‑factor authentication where feasible.
  2. Promptly notify us at opt-out@medicareguideline.com of any actual or suspected security breach involving the Services or Transferred Data.
  3. Immediately stop using any compromised credentials and cooperate with our remediation efforts.

5. Monitoring & Enforcement

  • Right to Monitor. We may monitor, audit, or investigate your use of the Services to verify compliance with this AUP and applicable law.
  • Violation Response. We may, without notice, suspend or terminate access, remove content, block traffic, or take any other action we deem necessary to enforce this AUP or protect our systems and users.
  • Reporting. Suspected violations may be reported to law‑enforcement or regulators where required or appropriate.

6. Reporting Violations

To report a violation of this AUP, please email opt-out@medicareguideline.com with the subject line “AUP Violation” and include:

  • Your contact information;
  • A detailed description of the alleged violation;
  • Relevant evidence (e.g., message headers, call recordings, URLs).

We will investigate and, if we deem necessary, take appropriate action.

7. Changes to This AUP

We may revise this AUP at any time. Updated versions will be posted at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
